This matter is taken up through video conferencing mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is apprehending arrest for the alleged commission of offence under Sections 294, 323, 379 and 506 of the IPC read with Section 3 of the SC & ST (PA) Act in Special Case No.303 of 2018 of the court of Special Judge, SC & ST, Balasore, arising out of Simulia P.S. Case No.267 of 2018.

Keeping in view the nature of allegations and fact of the case, this Curt is not inclined to grant anticipatory bail to the petitioner. However, keeping in view the submission made by the learned counsel for the petitioner, he is given liberty to

// 2 // surrender before the learned Special Judge, SC & ST, Balasore in the aforesaid case within 21 days and apply for bail. On such event, the learned Special Judge shall consider his application and dispose of the same on the same day. Case Diary be made available to the concerned court on the relevant date. 5.

The ABLAPL is disposed of.

As the restrictions due to the COVID-19 situation are continuing, learned counsel for the parties may utilize a soft copy of this order available in the High Court's website or print out thereof at par with certified copy in the manner prescribed, vide Court's Notice No.4587, dated 25 March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
