Heard Mrs. S. Jena, learned counsel for the petitioner; Mr. S. Purohit, learned counsel for opposite party no.2 and Mr. A.K. Mishra, learned Additional Government Advocate for the State. 3.
The petitioner has filed this writ petition assailing the order dated 02.05.2017 under Annexure1 passed by opposite party no.2, by which the petitioner has been black listed till further order along with forfeit of his EMD as per para 15(f) e-tendering of OPWD Code.

Since the tender process has been over, the writ petition has become infructuous by efflux of time. However, liberty is granted to the petitioner to pursue
his remedy before the appropriate forum, if any cause of action survives.

With the above observation, the writ petition stands disposed of.
