This matter is taken up by video conferencing mode. 2.

Mr. Dash, learned counsel for Petitioner submits that for the respondent being made ex parte, there was some obstruction in the closure of evidence. Mr. Dash, learned counsel for Petitioner also makes a statement that in the meantime the position of the respondent having been restored, there is no obstruction in recording her evidence or cross examination at her instance involving the dispute.

Considering the submission made by Mr. Dash, learned counsel for Petitioner and keeping in view the progress in the matter, this Court directs, all such steps shall be taken to dispose of the C.P. No.794 of 2020 within a period of four months from the date of communication of an authenticated copy of this order by the Petitioner, but however, providing opportunity of cross examination and examination to the respondent.

The writ petition stands disposed of with the above order. 5.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021 and Court's Office order circulated vide memo Nos.514 & 515 dated 7th January, 2022.
