2. Heard Mr. S.K. Dash, learned counsel for the Appellant.

3. This matter in the list yesterday and on the request made by the learned counsel for the Appellant, the matter was listed today.

4. This appeal has been filed challenging the interim award passed by the learned second M.A.C.T. Sambalpur in Misc. (A) Case No. 256 of 1999. On query made by this Court, learned counsel for the Appellant took time yesterday to appraise the Court as to whether the original case in the meantime is disposed of or not. Today when the matter was taken up, learned counsel for the Appellant again prayed for time to appraise the Court.

5. Even though the appeal was filed in the year 2003 and this Court vide order dated 13.03.2003 issued notice on the respondents but no requisites has been filed for issuance of notice till date.

6. In view of the above, this court is not inclined to interfere with the matter and the same is dismissed..
