Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 15.11.2021 in connection with Chandrapur P.S. Case No.50 of 2021 corresponding to T.R. Case No.104 of 2021 pending in the Court of learned Addl. Sessions Judge-cum-Special Judge, Gunupur for the alleged commission of offence under Sections 20(b)(ii)(C)/25/29 of NDPS Act.

The allegation is that the petitioner in association with seven other persons was travelling in Bolero vehicle which was also loaded with 60 kgs of contraband ganja.

It is submitted by Mr. G. Mishra, learned Sr. Counsel appearing for the petitioner that apart from the fact that nothing was seized from the conscious and exclusive possession of the petitioner fact also remains that the petitioner is at an advanced stage of pregnancy with her expected date of delivery being 23.04.2022. In support of such contention, necessary medical

documents have been enclosed to the bail application. 6.

Considering the submissions as above and particularly, taking note of the fact that the petitioner is expected to deliver a child very soon, this Court is inclined to take a lenient view in the matter. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that she shall appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
