1. The mediation was not successful.

2. Learned Senior Counsel appearing for both the parties leave it to the Court to appoint any Arbitration of its choice to adjudicate the dispute between the parties in view of the amendment in 2015 of the Arbitration and Conciliation Act, 1996.

3. In that view of the matter, the Court appoints Dr. Justice A. K. Rath, former judge of this Court, as the sole Arbitrator to adjudicate the disputes between the parties, including their claims and counter-claims. The arbitration shall take place under the aegis of the High Court of Orissa Arbitration Centre. It would be open to the parties to seek appropriate interim reliefs in the said arbitration proceedings in accordance with law.

4. The writ petition is disposed of in the above terms. A copy of this order be communicated to the Coordinator, Orissa High Court Arbitration Centre and the learned Arbitrator forthwith. (Dr. S. Muralidhar) Chief Justice (R. K. Pattanaik) Judge M. Panda
