This matter is taken up through Video Conferencing mode. 2.

Heard learned counsel for both the parties and perused the records.

The Petitioner is apprehending arrest for the alleged commission of offence under Sections 20(b)(ii)(c) of the NDPS Act in T.R.Case No.135 of 2019 of the Court of Sessions Judge-cumSpecial Judge, Malkangiri arising out of Motu P.S.Case No.74 of 2019.

Keeping in view the nature of allegations, gravity of offence and fact of the case, this Court is not inclined to grant anticipatory bail to the Petitioner. However, keeping in view the submission made by the learned counsel for the Petitioner, he is given liberty to surrender before the learned Sessions Judge-cum-Special Judge, Malkangiri in the aforesaid case within 21 days and apply for bail. On such event, the learned Special Judge shall consider his application and dispose of the same on the same day. While

// 2 // disposing of the bail application, he shall keep in mind the principles of parity. Case Diary be made available to the concerned court on the relevant date.

The ABLAPL is accordingly disposed of.

As the restrictions due to resurgence of COVID -19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Court's Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
