1. Considering the fact that the Opposite Party is going to retire on 31st March, 2022, the Court considers it appropriate to not interfere with the impugned Award and direct that the question of law arising from the impugned Award of the Industrial Tribunal, Bhubaneswar in Industrial Dispute Case No. 3 of 2003 is left open to be decided in some other appropriate case. It is further clarified that the impugned Award will not constitute a precedent and will be understood as being peculiar to the facts of the case.
