ORDER

23.02.2022 05.

1. The Petitioner is aggrieved by an order dated 18th October, 2005 (Annexure-3) passed by the Tahasildar, Rayagada which admittedly is an appealable order under the OLR Act.

2. Consequently, permitting the Petitioner to file such appeal under Section 58 of the OLR Act and further directing that if such an appeal is filed not later than 4th April, 2022 accompanied by an application for condonation of delay on account of pendency of the present petition, the appellate authority will consider the appeal on its merits. In such event, the interim order passed by this Court on 19th January, 2012 will continue till such time the Appellate Authority disposes of the application for interim relief to be filed by the Petitioner along with the appeal.

3. The Court clarifies that it has not expressed any opinion on the merits of the case.

4. The writ petition is disposed of in the above terms.
