1. This matter is taken up by virtual/physical mode.

2. The Petitioner, a partnership firm is a defaulter in servicing the Cash Credit facility availed in December 2009 from Bank of Baroda, Rourkela Branch, DistrictSundargarh leading to the account being classified as NPA on 31.12.2012 and initiation of recovery proceedings under the SARFAESI Act, 2002 (in short 'the Act, 2002') by issuance of a notice under Section 13(2) of the Act, 2002 on 10.01.2013 recalling the outstanding amount of Rs.1,83,07,763.00.

3. At the time of hearing, learned counsel for the Petitioner files a Memo indicating therein that the writ petition has become infructuous and prays for permission to withdraw the writ petition on account of conclusion of the recovery proceedings under the Act, 2002. The Memo be kept on record.

4. In view of the Memo filed, the writ petition is dismissed as withdrawn.
