This matter is taken up through Video Conferencing Mode.

Heard Mr. Mohanty, learned counsel for the Petitioner and Mr. Dash, learned Additional Government Advocate. 3.

According to Mr. Mohanty, the Petitioner is aggrieved by non-disbursal of the compensation amount of Rs.6,19,413/- along with accrued interest as per judgment dated 12th April, 2013 passed in LA Misc. case No.20 of 2011 passed by learned Civil Judge, Senior Division, Jagatsinghpur under Annexure-1. He further submits that though challenging the same he filed an appeal before this Court vide LAA Case No.78 of 2013, however, the same was disposed of as not pressed on 13th February, 2020. Thereafter, though on 5th May, 2020, the Petitioner has preferred a representation before the Collector-cum-Land Officer, Jagatsinghpur (OP No.2) for disbursal of the above noted amount, however, till date nothing has been done. In such background, a direction may be issued to Opposite Party No.2 to take a decision on the above noted representation within a specified time period.

Considering such submissions, this Court without expressing any opinion on the merits of the case, directs

// 2 // Opposite Party No.2- Collector-cum-Land Officer, Jagatsinghpur to take a decision on the above noted representation of the Petitioner within a period of three months from the date of production of a copy of this order after giving opportunity of hearing to the Petitioner as well as Opposite Party No.3 (Sabita Mohapatra), Opposite Party No.4(Parbati Mohapatra), Opposite Party No.5(Gorachand Mohapatra) in accordance with law and Opposite Party No.6(Goutam Mohapatra) and communicate result of such exercise to the Petitioner.

With the aforesaid direction, the writ petition is disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587 dated 25th March, 2020, modified by Notice No.4798 dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
