This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.
This is an application for bail under section 439 of Cr.P.C. in connection with P.R. Case No.286/201920 corresponding to 2(a) CC Case No. 07 of 2020 pending in the Court of learned Sessions Judge -cumSpecial Judge, Cuttack for alleged commission of offences under section 20(b)(ii)(C) of the NDPS Act. Perused the status report dated 04.05.2022 submitted by the learned trial Court from which it appears that the case is now posted to 19.05.2022 for argument.
// 2 // In that view of the stage of the trial, while not inclining to release the petitioner on bail, but taking into account the period of detention of the petitioner in judicial custody, I direct the learned trial Court shall make every endeavour to expedite the trial and conclude the same by the end of June 2022.
Accordingly, the BLAPL is disposed of.
A copy of the order be communicated to the learned trial Court for compliance.
Urgent certified copy of this order be granted on proper application.
