Considering the allegation made in this writ petition and without entering into any such controversies at this stage, this Court directs the Tahasildar, Nimapada-O.P.5 to look into the grievance of the Petitioner vide Annexure-3 and make an enquiry involving the parties likely to be affected. It is directed that upon entering into an enquiry, if the Tahasildar, Nimapada observes, there is unauthorized occupation over the Govt. land, the Tahasildar shall initiate an appropriate proceeding following the provisions contained in the O.P.L.E. Act and decide the same within a period of six months thereafter, but however, giving opportunity of hearing to the parties likely to be affected. It is further directed that if there is exigency for interim protection, upon filing of an application for interim protection by the Petitioner, the Tahasildar, Nimapada shall do well in passing a lawful order thereon within a period of one month thereafter.
