1. Counsel for the Petitioner seeks leave to withdraw the present Order No.

petitions with liberty to approach the Excise Commissioner in accordance with law against the impugned order. If such petitions are filed no later than 22nd August, 2022 citing the pendency of the present petition as the reason for the delay to be considered by the Excise Commissioner in accordance with law. It is clarified that this Court has not expressed any opinion on the merit of the case.

2. The interim order passed by this Court on 2nd July, 2013 in W.P.(C) No.9490 of 2013 and corresponding interim order passed by this Court on 18th March, 2013 in W.P.(C) No.3978 of 2012 will continue till the Excise Commissioner passes an appropriate interim order on the applications of interim relief filed in both matters by the Petitioner provided the revision petitions are filed within the time stipulated. The Excise Commissioner will

endeavour to dispose of the petitions within a period of four months thereafter.

3. Both the petitions are disposed of as withdrawn with liberty as prayed for in the above terms.
