This matter is taken up through hybrid arrangement (virtual/physical mode).

Petitioner had been sanctioned a Term Loan of Rs.27,16,000/- by the Orissa State Financial Corporation vide sanctioned order dated 18th January, 2001 availed for construction of a Market Complex known as "Samantaray Market". However, at the time when only Rs.15,00,000/- had been disbursed, the Opposite Parties vide memo dated 11th October, 2002 intimated for cancellation of the balance loan amount in view of deviation of the approved construction plans submitted by the petitioner.

By filing the present Writ Petition, challenge has been laid to a memo dated 1st October, 2004 (Annexure-5) issued by the Opposite Parties declining the request of the petitioner for refund of the proportionate processing charges and waiver of interest.

At the time of hearing today, learned counsel for the petitioner states that he has no instructions apart from petitioner having died, whereas learned counsel for the O.S.F.C. states that the Writ Petition has become infructuous in view of No Dues Certificate having been issued way back on 25th February, 2004 itself.

In view of the above, the Writ Petition is dismissed as infructuous.
