ORDER (Oral) 23.02.2022 04.

1. This matter is taken up by virtual/physical mode.

2. The Petitioner is the successor in interest/LR of the loanee against whom an outstanding liability of ₹3,51,400.00 as on 24.01.2022 stands in NPA account.

3. The Petitioner by filling the present petition has made a mercy plea for grant of some reasonable time to clear the outstanding liability and close the account.

4. It is conceded by the counsel for the Bank that in terms of the previous interim orders, the Petitioner has deposited a sum of ₹1 lakh and outstanding amount

// 2 // around ₹3,05,000.00 requires to be paid to close the account.

5. Counsel for the Petitioner submits that in compliance of the interim order, he has filed an undertaking before the Bank to pay the remaining balance within three months i.e. before 31.05.2022.

6. In the facts of the present case, taking a holistic view, we dispose of the present petition with a direction to the Petitioner to pay the remaining balance positively before 31.05.2022, failing which no further indulgence shall be extended.

7. The Bank is directed not to initiate any coercive steps till 30.05.2022 and in case the required amount is deposited, the loan account shall be closed and the title deed shall be returned to the Petitioner in accordance with the Rules of the Bank.
