Heard learned counsel for the Parties.

This Court takes into consideration the statement of Mr.Mohapatra, learned counsel appearing for the Petitioner that for the development in the Sou motu O.E.A proceeding, there has been preferring of Appeal by the Petitioner which appears to be pending. There is no dispute to such submission by Mr. Bhuyan, learned counsel appearing for the Opposite Parties.

In the circumstance and as ultimately fate of the parties involved herein shall be abided on the finality of the OEA proceeding involving O.E.A. Case No.63 of 1980, this Court while disposing the Writ Petition further observes the order passed under the provision of O.C.H. & P.F.L Act shall ultimately be abided by the finality of the OEA Sou motu proceeding.

The Writ Petition stands disposed of.
