This matter is taken up through Hybrid mode.

This application under Section 482 Cr.P.C. has been filed by the Petitioners for quashment of the FIR in connection with Balanga P.S. Case No.121 of 2012 corresponding to G.R. Case No.702 of 2012 pending before the learned J.M.F.C., Nimapara.

Learned counsel for the Petitioners submits that he has no instruction in this matter.

In such view of the matter, this Court is of the view that the Petitioners are recalcitrant litigants and do not want to proceed with the matter.

Accordingly, this CRLMC stands dismissed for nonprosecution. 6.
However, liberty is given to the Petitioners to approach the appropriate forum, if charge sheet has been filed and cognizance has been taken and they have been proceeded in the aforesaid case, if so aggrieved.
