The matter is taken up through hybrid arrangement Order No.

(virtual/physical) mode.

This is the second journey of the Petitioner who is in custody in connection with Angul P.S. Case No.231 of 2018 corresponding to C.T.(S) Case No.26 of 2020 pending on the file of learned Addl. Sessions Judge (LR & LTV), Angul for alleged commission of offence under Section -395 of the IPC read with Section-25/27 of the Arms Act, in filling this application under section 439, Cr.P.C. for reconsideration of his prayer for grant of bail to the Petitioner in the above mentioned case.

Heard learned Counsel for the Petitioner and learned Counsel for the State.

Considering the submissions made and on going through the materials as placed, it is seen that the Court in seisin of the case was last moved by the Petitioner for his release on bail on 30.11.2021, when charges had not been

// 2 // framed. In the meantime, as seen, ten witnesses from the side of the prosecution have already been examined and out of them, many are also material witnesses. In view of the above, this application stands disposed of granting liberty to the Petitioner to renew his prayer before the Trial Court for his release on bail citing all the developments which have taken place in the meantime in their proper perspective for being taken into consideration and disposal in accordance with law without being influenced by this order.

The BLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
