Heard learned counsel for the Petitioner, learned counsel for the informant and learned counsel for the State. 3.

The Petitioner is an accused in G.R. Case No. 17 of 2020, on the file of learned Special Judge(POCSO Act)-cumAdditional Sessions Judge, Berhampur, District-Ganjam, arising out of Sadar P.S. Case No. 81 of 2020, under Sections 376(2)(n)/376 of the I.P.C. and Section 6 of the POCSO Act. 4.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Special Judge (POCSO Act)- cum-Additional Sessions Judge, Berhampur, District-Ganjam by order dated 16.12.2020, in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim submitted by the learned counsel for the informant. 6.

Admittedly Charge-Sheet has already been filed since 27.05.2020.

It is stated at the Bar that trial has not commenced. 8.

It is submitted that the Petitioner is in custody since 19.10.2020 9.

Taking into account the period of detention and the nature of allegation, this Court directs that the Petitioner shall be released on bail on such terms and conditions to be fixed by the court in seisin of the matter.

Accordingly, the BLAPL stands disposed of.
