This matter is taken up through hybrid mode.

This writ petition has been filed assailing the order dated 12th November, 2012 (Annexure-4) passed by learned 1st Additional District Judge, Berhampur in F.A.O. No.2 of 2012, whereby he confirmed the order dated 1st October, 2010 (Annexure-3) passed by learned Civil Judge (Senior Division), Berhampur in I.A. No.19 of 2009 (arising out of C.S. No.34 of 2009), rejecting an application under Order XXXIX Rules 1 and 2 C.P.C.

Mr. Samantaray, learned counsel for the Petitioners submits that the matter has already been settled under the OTS and hence by filing a memo dated 9th November, 2022 (Flag-N) prays for withdrawal of the writ petition.

The writ petition is accordingly disposed of as withdrawn.

Interim order dated 11th December, 2012 passed in Misc. Case No.19705 of 2012 stands vacated.
