Heard Mr. Ipsit Acharya, learned counsel for the petitioner and Mr. P.P. Mohanty, learned Additional Government Advocate and Mr. P.P. Behera, learned Central Government Counsel. 3.

The petitioner has filed this writ petition seeking to quash the demand of interest under Annexures-19 and 20 and to direct the opposite parties to declare the petitioner to have been exempted from paying NPV in respect of 53.913 hectares and also to refund the collected NPV to him.

Learned counsel for the petitioner contended that similar question had come up before this Court in Banwarilal Newatia vs. State of Odisha and others, 2017 (Supp-I) OLR 71 and also in the case of Prabodh Mohanty vs. State of Odisha, W.P.(C) No. 12660 of 2014 disposed of on 02.11.2021 and the case of the petitioner may be disposed of in terms of the observation/direction given in the said judgments, to which learned counsel for the opposite parties have no objection.

In view of the above, this writ petition stands disposed of directing the opposite parties to consider the case of the petitioner in the light of the judgments as mentioned above and take a decision thereon within a period of three months from the date of communication of the order.
