Heard Mr. B. Rout, learned Counsel for the Petitioner and Mr. S. Nayak, learned Additional Standing Counsel appearing for the StateOpposite Parties. 3.

The Petitioner has filed this Writ Petition seeking to quash the Order dated 28.09.2012 passed by the Odisha Administrative Tribunal, Cuttack Bench, Cuttack in P. No. 56 (C) of 2012 under Annexure-1, and to issue direction to the Opposite Parties to consider his case for appointment/engagement for the post of Constable or Sepoy in any place.

Since the selection to the post of OSAP Constable and Sepoy was of the year 2008-09 and because of involvement of the Petitioner in a criminal case he was not selected, the Tribunal is well justified in passing the Order impugned. As such, we do not find any illegality or irregularity committed by the Tribunal so as to warrant interference with the same.

Accordingly, the Writ Petition merits no consideration and the same is hereby dismissed.
