This matter is taken up through hybrid mode.

Heard the learned counsel for the Petitioner and the learned counsel for the State.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the entire proceeding of S.C. No.18 of 2006 pending before the learned Assistant Sessions Judge, Ganjam-Gajapati, Berhampur. 4.

It is stated by the learned counsel for the Petitioner that a case was initiated vide 2(a)C.C. No.177 of 2004 for the self same cause while another sessions case is pending. As such, he has come to this court with a prayer to quash the aforesaid session case.

However, from the letter No.808 dated 29th April, 2022 of the learned S.D.J.M., Berhampur, it reveals that 2(a)C.C.

// 2 // No.177 of 2004 on the file of the learned S.D.J.M., Berhampur having already been disposed of and with a judgment of acquittal.

Hence, giving liberty to the Petitioner to raise the contention of autrefois acquit, if he has already for the selfsame cause faced trial and acquitted, to file a petition within eight weeks hence, the court concerned to pass necessary order within fifteen days thereafter, this petition stands disposed of.
