Heard learned counsel appearing for the parties. Order No.

For clear statement in the counter affidavit that land involved herein is not available since already allotted. There is specific assertion that it has been leased out in favour of Indian Counsel of Agriculture Research (ICAR), New Delhi as per the order passed in the Alienation/WL Case No.377 of 1983. In the circumstance, it appears this land was even not available at the time of considering the same in favour of the petitioner appearing through a recommendation at Page-17, a document dated 24.11.2008.

In this view of the matter this Court finds nothing survives to be adjudicated in the writ petition and thus is dismissed accordingly.
