The petitioner is a defaulting borrower of a Order No.

loan availed for a sum of Rs.4,96,000/- on 31.05.1999 from UCO Bank, Athagarh Branch, DistCuttack, who is facing recovery process under the SARFAESI Act, 2002 in view of the account having been classified as NPA on 29.08.2008.

Challenge in the present writ petition is to the E-auction sale notice dated 23.12.2021, whereby the mortgaged property, offered as collateral security, is being put to auction on 10.1.2022.

At the time of hearing, learned counsel for the Bank submits that the present writ petition has become infructuous in view of the auction fixed for

// 2 // the aforesaid date having failed for want of any intending bidders.

None has appeared to controvert the aforesaid Bank. The position was the same on the previous date of hearing.

In view of the above, the Writ Petition is dismissed as infructuous.
