07. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard learned counsel for the Appellant.

3. This appeal has been filed by the Appellant challenging the order dt.16.11.2002, passed in Misc. Case No. 02/1996 by the learned District Judge, Balasore-Bhadrak, Balasore.

4. Even though this Court vide order dtd.28.06.2007 directed issuance of notice against the sole Respondent by Registered post, but office note indicates that no requisite was filed for issuance of such notice. In view of that this Court is not inclined to interfere with the impugned order and accordingly dismiss the appeal.

5. It is however observed that the Corporation, if it so likes, can take action in terms of the provision contained under Sec. 32(G) of the State Financial Corporation Act, 1951.

6. The appeal is disposed of accordingly.
