Heard Mr. D.K. Sahoo-1, learned counsel for the petitioner and Mr. S.N. Nayak, learned Additional Standing Counsel for the State-opposite parties.

The petitioner has filed this writ petition assailing the order dated 11.03.2013 passed by the Odisha Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No. 2329 (C) of 2011, by which the Tribunal has disposed of the original application with an observation that neither the petitioner nor opposite party no.5, both of whom are reportedly 45% hearing impaired, are eligible for selection and appointment as orthopedically handicapped candidates, can be eligible for appointment as Village Agriculture Workers under the physically handicapped category as per G.A. department Resolution No. 3404/G.A. dated 13.02.2006, referred to in the advertisement at Annexure-1.

Mr. D.K. Sahoo-1, learned counsel for the petitioner contended that this matter relates to the selection of the year, 2011 and in the meantime more than 10 years have been elapsed. Therefore, by efflux of time, the writ petition has become

infructuous.

In view of the above submission, the writ petition stands disposed of as infructuous.
