This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to set aside the order dated 4th March, 2014 passed by the learned S.D.J.M., Khurda in 1.C.C. Case No.28 of 2011.

Heard the learned counsel for the Petitioner and the learned counsel for the State-Opposite Party No.1. 4.
It appears that the learned S.D.J.M., Khurda vide the impugned order dismissed the complaint petition of the Petitioner for his non-appearance.

Since the case is triable by warrant procedure, this Court set aside the impugned order and directs the learned S.D.J.M., Khurda to restore the same to file.
