1. The challenge is to an order dated 26th October, 2002 passed by the Additional Tahasildar, Bhubaneswar in W.L. Case No.838 of 1972.

2. The Petitioner who claims to be a purchaser from the original vendor prior to the cancellation of lease was apparently not issued notice prior to the passing of the impugned order. On that short ground, the impugned order dated 26th October, 2002 is hereby set aside and W.L. Case No.838 of 1972 stands remanded to the court of Additional Tahasildar, Bhubaneswar for being proceeded with in accordance with law. W.L. Case No.838 of 1972 will be listed before the Additional Tahasildar, Bhubaneswar on 17th August, 2022 on which date the Petitioner will appear before the said authority along with a certified copy of the present order. The Additional Tahasildar is requested to thereafter proceed in accordance with law and dispose of the said W.L. Case No.838 of 1972 within a period of six months

// 2 // after hearing the Petitioner. Till then, the interim order passed by this Court on 25th March, 2013 shall continue.
