This matter is taken up through hybrid mode.

The petitioner has filed this writ petition assailing the order dated 18.12.2012 passed by the Orissa Administrative Tribunal in O.A. No. 185 of 2010 under Annexure-1.

As it appears, while passing the order impugned, the tribunal taking into consideration all aspect, disposed of the original application filed by the petitioner directing the opposite parties to consider the case of the petitioner again and pass speaking order within a period of three months on the prayer of the petitioner in his representation as at Annexure-2. Therefore, there is no valid and justifiable reason to approach this Court by filing the present writ petition assailing the order of the tribunal, particularly when the tribunal has already directed to consider the case of the petitioner.

In the above view of the matter, this Court is not inclined to entertain this writ petition. However, liberty is granted to the opposite parties to comply the order dated 18.12.2012 passed by
the tribunal within a period of three months, if the same has not yet been complied with.

The writ petition is accordingly disposed of. Issue urgent certified copy as per rules.
