This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 18th June, 2007 passed by the learned S.D.J.M.(S), Baripada in Crl. T.R. G.R. No.1049 of 2005, taking cognizance of the offences under Sections 409, 420 read with Section 34 of the I.P.C. and issuing process against him.

Learned counsel for the Petitioner submits that he wants to withdraw this petition with liberty to the Petitioner to raise all such contention at the stage of framing of the charge before the court in seisin over the matter.

In view of such submission, the CRLMC stands disposed of with the observation that if a contention is raised by the Petitioner at the time of framing of charge before court in seisin over the matter that no case is made out against him, the court in seisin over the matter shall consider and dispose of the same on its own merit in accordance with law without being influenced by this order of withdrawal in any manner..
