The matter is taken up through hybrid mode.

Heard Mr. B. Singh, learned counsel for the claimants and Mr. J.R. Deo on behalf of Mr. G. Mishra, learned Senior Counsel for the insurer.

It is submitted by Mr. Singh for the Petitioners that the claimants are the widow and daughter of the deceased and due to poverty they could not prefer the appeal in time. 4.
There is delay of 329 days in preferring the appeal. 5.
Mr. Singh fairly concedes that the claimants have received the compensation amount as directed by the tribunal in time. As such, the submission advanced by the Appellants to condone the delay is not found satisfactory. Resultantly the limitation is not condoned and the Misc. Case is dismissed. Consequently the appeal is dismissed on the ground of limitation.
