2. Mr. S.P. Mishra, learned Senior Counsel for the petitioner states that in view of filing of T.S. No.117 of 2015 before the learned Civil Judge (Sr. Division), Kujanga with counter claim, this writ petition has become infructuous.

3. Accordingly, this writ petition stands disposed of as infructuous.
