1. This matter is taken up by virtual/physical mode.

2. The defaulting loanee is before this Court seeking an extension of time period for deposit of the amount sanctioned under the OTS. On the previous date of hearing, to check the bona fide of the Petitioner, we had directed the Petitioner to deposit a sum of ₹38 lakhs within one week while issuing notice for today.

3. At the time of resuming of hearing today, counsel for the Bank points out that no such deposit has been made.

4. At this stage, counsel for the Petitioner prays for permission to withdraw the writ petition.

5. In view of the above, the writ petition is dismissed as withdrawn with the liberty to the Petitioner to pursue his remedy in accordance with law.
