Heard Mr.M.Sinha, learned counsel for the Appellant. None appears for the Respondent when the matter is called out.

It is submitted by Mr. Sinha, learned counsel for the Insurance Company that originally three awards were passed analogously in three cases against which three appeals have been filed, being M.A Nos.137, 138 and 139 of 2002 and during pendency of the said appeals, a further award has been passed imposing penalty and interest, which has been challenged in this appeal.

Since the award passed was challenged by the Appellant before this Court and after disposal of the said appeal, the amount has been duly deposited before the

// 2 // learned Tribunal, the impugned order passed by the learned Tribunal during pendency of the matter before this Court is not legal and proper.

Accordingly, the said order is set aside and the appeal is allowed.
