1. It is stated that against the same impugned award of the IIIOrder No. MACT, Balasore dated 4th September, 2003, the National Insurance Company had filed MACA No.819 of 2003 in this Court, which was allowed by the judgment dated 25th April, 2008 and the present Appellant i.e. Oriental Insurance Co. Ltd. has been made liable to pay the claimant the recalculated amount in terms thereof.

2. In view of the said judgment of this Court dated 4th September, 2003, the present appeal is disposed of in the same terms. (Dr. S. Muralidhar) Chief Justice M. Panda
