Heard Mr. B.K. Ghadei, learned counsel for the Petitioner and Mr. P.K. Mohanty, learned ASC for State - Opposite Party. 2.

Admittedly the name of Petitioner is not there in the chargesheet and no step has been taken either on protest or otherwise to implicate the Petitioner in the offence. As such, the prayer of the Petitioner to delete his name from the F.I.R. is completely misconceived.

Accordingly, the CRLMC is dismissed.
