Heard learned counsel for the Parties.

There is no dispute in the Bar that undertaking the Mutation exercise is being obstructed for the pendency of F.A.O. No.20 of 2015 in this Court. Mr. Mohanty, learned Senior Counsel making it clear that F.A.O. is still pending in this Court involving the remand order passed by the Appellate Court.

For the opinion of this Court unless the F.A.O. No.20 of 2015 is disposed of, there is development showing in the suit ultimately there may not be any scope for entering the request involved herein through mutation proceeding.

The Writ Petition stands disposed of for there is no scope entertaining the Writ Petition at this stage however with liberty to the Petitioner to approach in appropriate proceeding, subject to however on the outcome in F.A.O. No. 20 of 2015.
