Mr. Amitav Tripathy, learned counsel for the Petitioner submits that he has no instruction in the matter from his client. 3.

In such view of the matter, this Court is of the view that the Petitioner is recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for non-prosecution giving liberty to the Petitioner to revive the application by filing an appropriate petition within time or a fresh petition, if so desired. 5.

Interim order dated 5th September, 2012 passed by this Court in Misc. Case No.1723 of 2012 stands vacated. (S. Pujahari) Judge DA
