This writ petition has been filed assailing order dated 5th January, 2006 (Annexure-1) passed by learned Civil Judge (Senior Division), Bhadrak in CS No.367 of 1996. 3.

Mr. Mohanty, learned counsel for the Petitioner filed a memo stating that the writ petition has now become infructuous by efflux of time.

In view of the memo filed, the writ petition is dismissed as infructuous.

Interim order dated 27th February, 2006 passed in Misc. Case No.842 of 2006 stands vacated.
