Heard learned counsel for the Parties.

Even though the order at Annexure-3 is challenged on the premises that while passing the order of remand, the Commissioner did not take into account the effect of decree already obtained in S.A. No.200 of 75.

Considering the limited grievance of Mr.Parija, learned counsel for the Petitioner, this Court while declining to interfere in the impugned order as the order involved a remand order and there is scope before the Deputy Director, Consolidation permits the Petitioner to agitate all such issues. This Court in disposal of the Writ Petition simply observes in the event a civil court decree has come to the rescue of either of the Parties, it may be open to such parties to take such stand and attempt may be there to establish such case through production of appropriate certified copy.
