Heard the submissions of both the parties.

In course of submission, in limiting his request learned counsel for Petitioner submits that in the meantime the Petitioner has already been promoted to the higher post since 1.11.2016 and thus requested this Court to permit the Petitioner to withdraw this Writ Petition with liberty to make a fresh representation to the authority. 3.
Keeping in view the above request of the learned counsel for Petitioner, this Court while permitting the Petitioner to withdraw this Writ Petition also grants liberty to the Petitioner that in the event any cause of action involving this issue still survives, it may be open to the Petitioner to approach the competent authority with appropriate representation.

The Writ Petition is, accordingly, disposed of as withdraw, but however, with liberty as prayed for.
