This matter is taken up by virtual/physical mode. 2.

The Petitioner is a defaulting borrower of a cash credit facility availed to the tune of Rs.8,00,000/-. Due to non-payment of installments, the loan account was declared NPA and the demand notice under Section 13(2) of the SARFAESI Act, 2002 (for short, 'the Act, 2002') was issued on 9th September, 2021 recalling an outstanding liability of Rs.13,60,933/-. The symbolic possession is stated to have been assumed by issuance of notice dated 21st December, 20021 under Section 13(4) of Act, 2002. Challenge is laid to the possession notice with further direction for consideration under the OTS policy.

At the time of hearing, counsel for the Petitioner by filing a memo in Court today, which is taken on record, prays for permission to withdraw the writ petition.

In view of the above, this writ petition is dismissed as withdrawn.
