This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

The petitioner is seeking pre-arrest bail in connection G.R. Case No.643 of 2021, arising out of Bargaon P.S. Case No.171 of 2021 pending in the court of learned J.M.F.C., Rajgangpur for commission of offence punishable under Sections 420/468/471 of I.P.C. 5.
Considering the nature of allegations and gravity of offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioner. However, it is observed that, in the event the petitioner surrenders before the learned Court in seisin over the matter within a period of three weeks from today, the petitioners shall be released on bail on such terms and conditions as the learned Magistrate may deem

Further, learned Court in seisin over the matter shall also impose two additional conditions that:
(i) he shall be cooperate with the Investigating Officer as and when required for the purpose of investigation. (ii) he shall appear before the trial Court on each and every date without fail.

Accordingly, the ABLAPL is disposed of.
Urgent certified copy of this order be granted on proper application.
