1. The issue before the Labour Court concerned is charging penal Order No.

rent from Opposite Party No.2 who had retired from the service of the Petitioner way back on 30th June, 1993 on attaining the age of 60 years. All that the Labour Court did was to direct the present Petitioner to compute the normal rent payable by Opposite Party No.2 for overstaying in the premises allotted to him.

2. Opposite Party No.2 would be over 88 years old now. The Court sees no purpose being served in the Petitioner now being permitted to pursue him to recover penal rent. Leaving all questions of law arising from the impugned order open, the Court declines to interfere with the present petition and the writ petition is accordingly disposed of. An urgent certified copy of this order be issued as per rules.
