This matter is taken up through video conferencing mode.

The Petitioner in this writ petition prays for a direction to set aside the order dated 19th December, 2018 passed by the Additional Tahasildar, Jatni-Opposite party No.3 in Mutation Case No.5909 of 2018.

In course of hearing, Mr. Mishra, learned counsel for the Petitioner submits that the Petitioner has a remedy under Rule 42 of the Orissa Survey & Settlement Rules, 1962 to assail the order impugned herein. Hence, he prays for withdrawal of the writ petition to avail statutory remedy.

Considering such submission, this writ petition is disposed of as withdrawn.

5.

Certified copy of Annexure-2 shall be returned to learned counsel for the Petitioner on substitution of attested photocopy thereof.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a

// 2 // printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate in the manner prescribed vide Court's Notice No.4587 dated 25th March, 2020 modified by Notice No.4798 dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
