The petitioner is in custody since 10.12.2021 in connection with Dharamgarh P.S. Case No.105 of 2020 corresponding to C.T. Case No.2 of 2020 pending in the Court of learned Additional Sessions Judgecum-Special Judge, Dharamgarh for the alleged commission of offence under Section 20(ii)(b)(c)/29 of NDPS Act.

Considering fact that the no contraband was seized from the exclusive and conscious possession of the petitioner and he has been implicated entirely on the basis of the statement of the co-accused, from whom the articles were seized, I find no justified reason to detain the petitioner in custody any longer. The prayer for bail allowed. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 5.
BLAPL is accordingly disposed of.
