1. The Petitioner approach to this Court way back on 11th November, 2009, questioning the action of the Orissa State Financial Corporation in seeking to recover monies 19 years after they became due.

2. The main ground on which the Petitioner challenged the action was limitation. However, despite notice have been issued on 7th December 2009, granting in interim order in favour of the Petitioner, it appears that the Petitioner did not take steps to file the process fee and deposit the 'Special Messenger' cost for service of notice on the OSFC.

3. Therefore, over 12 years now no notice could be served on OSFC. This is clearly a case of the Petitioner failing to prosecute the petition. It is dismissed on that ground.

4. An urgent certified copy of this order be issued as per rules.
