1. For the reasons stated therein, the delay in filing the appeal is hereby condoned.

2. The application for condonation of delay is allowed. MACA No.830 of 2006

3. Since the amount involved for the death of a person in an accident is just of Rs.86,000/-, the Court is not inclined to interfere with the matter. The appeal is accordingly dismissed.

4. Upon the Registry being shown by the Appellant the proof of deposit of the entire awarded amount before the MACT concerned, the statutory deposit made, will be refunded to the Appellant. (Dr. S. Muralidhar) Chief Justice S. Behera
